Warranty conditions

Warranty of Hämmerling The Tyre Company for tyres of the ‘ATHOS’ series (hereinafter: ‘Warranty’)

 

1.1 Warrantor

The warranty is granted by Hämmerling The Tyre Company GmbH (hereinafter: ‘Warrantor’) to the respective end customer as a manufacturer's warranty. Any claims of the end customer against its contractual partners remain unaffected by the guarantee.

The warranty for our truck tyres is ‘for life ’**. It is valid from the date of purchase of the tyre. Proof of purchase must be provided by presenting the original invoice. The tyre must be purchased between 15.07.2024 and 31.12.2024.

1.2 Products covered by the warranty

The warranty applies to tyres of the ‘ATHOS’ series manufactured by the guarantor (hereinafter: ‘tyres’).
The tyre must have been purchased between 15.07.2024 and 31.12.2024 to be covered by the warranty.
The purchase of the tyre must be recorded on the attached registration sheet.

1.3 Warranty period

The warranty for our truck tyres is ‘for life ’**. It is valid from the day the tyre is fitted by the end customer. Proof of purchase must be provided in the event of a warranty claim by presenting the original invoice.

1.4 Scope of guarantee

Our warranty covers material and manufacturing defects that lead to an unforeseen failure of the tyre. This includes:

  • Tyre bursts due to material defects
  • Abnormal tread wear due to manufacturing defects

 

2. Exclusions from the warranty

2.1. Wear and tear

Normal wear and tear, including but not limited to:

  • Tread wear.
  • Damage due to improper use or improper storage.

2.2. Mechanical impact

Damage caused by external factors such as:

  • Punctures, cuts or tears caused by foreign objects.
  • Damage caused by improper or incorrect assembly or disassembly

2.3. Misuse and negligence

Damage caused by improper use or care, including:

  • Incorrect (too high or too low) tyre pressure.
  • Use on vehicles carrying loads or travelling at speeds in excess of the recommended load or speed index
  • Incorrect axle alignment or balancing.
  • Use at excessive speed
  • Accidents, corrosion, contamination, modifications to the tyre or vandalism.
  • Fitting the tyre on the wrong rim
  • Climatic conditions or exposure to ozone.

 

3. Warranty claim

3.1 Warranty claim

A warranty claim is deemed to exist if the tyre was purchased during the period specified in section 1.2, the purchase was registered (section 1.2) and suffers a failure covered by the warranty (section 1.4) during the warranty period (section 1.3) and there is no reason for exclusion (section 2).

3.2 Service in the event of a warranty claim

In the event of a warranty claim, the customer shall receive a replacement for the tyre in question, i.e. the delivery of a new tyre of identical construction to the one with the defect. If the tyre to be replaced is no longer available, it can be replaced with a tyre from the ‘ATHOS’ series in the same size and with the same load and speed index. Within the scope of this guarantee, there is only a claim to delivery of a replacement tyre, not to payment of the monetary value of the replacement tyre. Furthermore, there is no entitlement to service or reimbursement of costs in relation to fitting, removal, repair, breakdown service or other workshop costs incurred.

In return for this lifetime warranty, the purchaser undertakes to provide the manufacturer with mileage data every 8 weeks. This is requested using a corresponding form and must be submitted to the manufacturer via the dealer.

3.3 Notification of the warranty claim

To make a warranty claim, you must contact the dealer from whom the tyre was purchased. A written description of the problem and proof of the date of purchase must be provided. The invoice or - if the invoice is not provided - the DOT number of the tyre is sufficient proof of the date of purchase.

3.4. Inspection and processing

Both the dealer and Hämmerling will inspect the tyre and inform the customer whether a warranty case exists. If a defect in material or workmanship is found, the tyre will be replaced at our discretion. If there is a warranty claim, a replacement tyre will be sent to the dealer from whom the tyre was purchased. The cost of despatch shall be borne by the guarantor.

You remain responsible for fitting the replacement tyre and disposing of the replaced tyre.

 

4. Limitation of liability

4.1. Limitation of the warranty

This warranty is in lieu of all other warranties, express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

4.2. Limitation of liability

Our liability under this warranty is limited to the replacement of the defective tyre. Any further liability, in particular for consequential damage, is excluded.

4.3 Warranty on the replacement product

A warranty identical to the present warranty also applies to the ‘replacement tyre’.

 

5. Applicable law and place of jurisdiction

These warranty conditions are subject to the law of the country in which the tyre was purchased. The place of jurisdiction for all disputes arising from or in connection with this guarantee is the registered office of the guarantor.

Footnotes:

**: ‘Lifetime’ means that the warranty on the tyre applies to one of the points listed in point 1.2 for the entire service life of the tyre. The service life ends when the tyre reaches the wear limit. The wear limit is reached when the Tread Wear Indicator (TWI) in the tread of the tyre indicates that the wear limit has been reached.
